Terms of Service

1. Agreement

These Terms of Service ("Terms") govern the business-to-business programs of Erb & Young Insurance operated under The Million Dollar Operator ("MDO," "we," "us"): our websites and funnels, free live training events such as Break the Ceiling Live, and The Million Dollar Operator community. By registering for an event, using our sites, or purchasing a membership, you agree to these Terms and to our Privacy Policy. Our programs are intended for business owners and professionals aged 18 or older.

2. Event registration

Live training events are free unless stated otherwise. Registration is personal to you; your Zoom join link is issued in your name and should not be redistributed. Seats and any replay access are provided as described on the event page — when we say a replay expires (for example, 48 hours after the event), it does. We may record events, and portions of an event may be edited out of any recording.

3. Our content and your license

All event content, recordings, frameworks, scripts, tools, and community materials are owned by Erb & Young or its licensors. You receive a limited, personal, non-transferable license to use them inside your own agency. You may not resell, republish, rebroadcast, screen-record, or share them outside your agency, use them to build a competing training program, or remove any proprietary notices.

4. Your conduct

You agree to provide accurate registration information and to keep community spaces professional: no harassment, no spam or unsolicited promotion to other members, no unlawful content, and no sharing of other members' information without their consent. We may moderate, suspend, or remove accounts that violate these standards.

5. Membership, billing, and cancellation

Paid membership pricing, billing frequency, and any founding-member terms are stated at checkout, and the checkout terms control. Memberships renew automatically at the stated interval until cancelled. You may cancel a monthly membership at any time, effective at the end of the current billing period; annual memberships may be cancelled to prevent renewal for the following year. Except where stated at checkout or required by law, payments are non-refundable once a billing period has begun. Founding-member pricing is locked only while the membership remains continuously active.

6. No earnings claims

We teach from our own experience operating Erb & Young. Results are not typical, and we make no promise of income, revenue, growth, or results. Figures we cite about our own business (such as premium written) are historical facts about us, not projections for you. Your results depend on your market, your effort, your team, and factors outside anyone's control.

7. Not professional advice

Program content is business education, not legal, tax, accounting, financial, or insurance-compliance advice. Consult your own advisors before acting on anything you learn in our programs.

8. Testimonials

Any member stories or testimonials reflect individual experiences with their permission. They are illustrations, not guarantees.

9. Third-party services

Our programs run on third-party platforms (Zoom, Kajabi, payment processors, and others). We are not responsible for outages, changes, or acts of those platforms, and your use of them is subject to their own terms.

10. Disclaimer of warranties

Our sites, events, and programs are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of liability

To the fullest extent permitted by law, Erb & Young and its owners, employees, and agents will not be liable for indirect, incidental, consequential, special, or punitive damages, or lost profits or revenues. Our total liability for any claim relating to the programs is limited to the amounts you paid us in the twelve months before the claim arose (or $100 if you paid nothing).

12. Indemnification

You agree to indemnify and hold us harmless from claims arising out of your violation of these Terms or your misuse of program content.

13. Termination

We may suspend or terminate access for violation of these Terms. Sections 3 and 6 through 14 survive termination.

14. Governing law and disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Florida, and you consent to their jurisdiction.

15. Changes

We may update these Terms; the effective date below reflects the latest version. Continued use after changes means you accept them.
